1. Agreement to Terms
Welcome to Onvoke ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, our web application, and our browser extension (collectively, the "Services"). By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.
2. Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. The Services
Our Services enable you to capture and submit information about your processes and actions ("User Content") in order to automatically generate documentation, tutorials, and other materials ("Generated Content"). You are solely responsible for the User Content you choose to submit while using our Services. We recommend you do not capture or submit any personal, sensitive, or confidential information not essential for the creation of your desired documentation.
4. User Content and Ownership
You retain all ownership rights to your User Content and the final Generated Content. We do not claim any ownership over it.
However, by submitting User Content to our Services, you grant Onvoke a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, process, transmit, and store your User Content solely for the purpose of: (a) providing the Services to you and generating your content; (b) improving and developing our Services; and (c) enforcing our policies and complying with legal obligations.
5. Subscriptions and Payment
Certain parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Your subscription will automatically renew at the end of each Billing Cycle unless you cancel it through your account settings.
You must provide accurate billing information and promptly update any changes. By submitting payment information, you authorize us or our third-party payment processor to charge all subscription fees to your payment instrument.
6. Our Intellectual Property
The Services, including all underlying software, technology, branding, and content provided by Onvoke (excluding Generated Content), are the exclusive property of Onvoke and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
7. Prohibited Uses
You agree not to use the Services for any purpose that is illegal or prohibited by these Terms. You agree not to:
- Use the Services in any way that violates any applicable national or international law or regulation.
- Submit any User Content that is defamatory, obscene, fraudulent, or infringes on any third party's intellectual property rights.
- Attempt to decompile, reverse engineer, or otherwise attempt to obtain the source code of the Services.
- Interfere with or disrupt the security or integrity of the Services or any data contained therein.
- Use the Services to build a competitive product or service.
8. Termination
We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
You may terminate your account at any time by discontinuing use of the Services or by deleting your account from your dashboard settings.
9. Disclaimer of Warranties
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Onvoke makes no warranties, express or implied, regarding the operation or availability of the Services or that the Generated Content will be accurate, reliable, or error-free. Your use of the Services is at your sole risk.
10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Onvoke, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Services.
11. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Kozhikode, Kerala, India to resolve any legal matter arising from the Terms.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
